Apatizer is an AI-powered video and content analysis tool that allows users to:

Retrieve and analyze transcripts from YouTube and TikTok videos.
Upload video files and images for AI-powered analysis.
Ask questions about video content and receive AI-generated responses.

The Service relies on third-party AI providers including Anthropic (Claude), AssemblyAI, and Supadata to process content.

3. Acceptable Use

You agree to use Apatizer only for lawful purposes. You must not use the Service to:

Analyze or distribute content that infringes on any third party's copyright, trademark, or intellectual property rights.
Submit content that is illegal, harmful, threatening, abusive, defamatory, or obscene.
Circumvent, reverse engineer, or attempt to access any part of the Service beyond its intended use.
Use automated scripts, bots, or scrapers to access the Service without prior written consent.
Violate the terms of service of YouTube, TikTok, or any other platform whose content is processed through Apatizer.
Use the Service for any commercial purpose without an appropriate paid subscription plan.

4. AI Analysis Disclaimer

Important: AI-generated transcripts and analysis results are provided for informational purposes only. Apatizer does not guarantee the accuracy, completeness, or reliability of any AI-generated content. Do not rely solely on Apatizer analysis for legal, medical, financial, or other professional decisions.

Transcription accuracy depends on audio quality, background noise, accents, and technical limitations of third-party services. Analysis results reflect the AI model's interpretation and may contain errors or omissions.

5. Intellectual Property

You retain all rights to content you submit to Apatizer. By submitting content, you grant Apatizer a limited, non-exclusive license to process that content solely for the purpose of providing the Service.

You are responsible for ensuring you have the right to submit any content to Apatizer for analysis. You must not submit content that violates copyright or other intellectual property rights.

The Apatizer name, logo, and all related branding are the exclusive property of Apatizer. You may not use our branding without prior written permission.

6. Limitation of Liability

To the fullest extent permitted by law: Apatizer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the Service, even if Apatizer has been advised of the possibility of such damages.

Our total liability to you for any claims arising from the use of the Service shall not exceed the amount you paid to Apatizer in the 12 months preceding the claim, or $100, whichever is greater.

7. Disclaimer of Warranties

Apatizer is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Third-Party Services & Links

Apatizer integrates with third-party services (Anthropic, AssemblyAI, Supadata, YouTube, TikTok). We are not responsible for the availability, accuracy, or content of these third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

9. Copyright & DMCA

Apatizer respects intellectual property rights. If you believe content processed through our Service infringes your copyright, please contact us at viralwealthhq@gmail.com with the following information:

A description of the copyrighted work you claim has been infringed.
The URL or description of where the alleged infringement is occurring.
Your contact information.
A statement that you have a good faith belief that the use is not authorized.
Your electronic or physical signature.

10. Termination

We reserve the right to suspend or terminate your access to Apatizer at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Maricopa County, Arizona.

We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes your acceptance of the updated Terms.
